Terms of Use

In the event of any contradiction between a translation and the Hebrew text, the Hebrew text shall prevail.

1. General and Agreement to Terms

Welcome to the transcription service of Tamleluya ("the Company", "we", "the Service"), operating at app.tamleluya.com. These Terms, together with the Privacy Policy which forms an integral part thereof, govern the use of the Service.

Opening an account is conditional upon active approval of these Terms (checking the consent box). We record the date of approval and the version of the Terms approved. If you do not agree to these Terms — please refrain from registering for or using the Service.

The Service is intended for individuals aged 18 and over. By registering, you represent that you are at least 18 years old, or that you have obtained the consent of a parent or legal guardian.

2. Nature of the Service

The Service provides automatic transcription of audio and video files using speech recognition and artificial intelligence technologies, as well as related tools: a transcript editor, subtitles, translation, summaries and documents, live recording, and sharing for proofreading purposes.

Automatic transcription is by nature imperfect and may include errors, omissions, and incorrect speaker identification. It is your responsibility to review and proofread the results before relying on them in any way. Automated output must not be relied upon for medical, legal, financial, or other decisions with material consequences — without full human review.

Parts of the Service may be marked as experimental (beta) and may change, be discontinued, or operate partially. The Service as a whole is provided "AS IS" and "AS AVAILABLE", without any commitment to continuous availability or to any particular level of accuracy.

3. User Account

When registering, you must provide accurate and up-to-date information. You are responsible for keeping your login credentials confidential and for all activity carried out under your account. You must notify us immediately of any suspected unauthorized use.

The account is personal and non-transferable. You may not open an account on behalf of another person without their authorization, or use another person's account.

4. Legality of Recordings and Content — User Representation

With respect to every file you upload or record using the Service, you represent and warrant that: (a) the recording was made lawfully — including in accordance with the Wiretapping Law, 5739-1979, which prohibits recording a conversation to which you are not a party without consent; (b) you have obtained all consents required from the participants in the recording, to the extent required by law, including for the purpose of processing and transcribing it; (c) you hold full rights and permissions in the content, and its upload and processing do not infringe copyright, privacy, or any other law.

Full responsibility for the legality of the content, for the consent of recorded individuals, and for compliance with the privacy laws applicable to you (including the Privacy Protection Law, 5741-1981, and where relevant the GDPR or other foreign laws) — rests with you alone.

If you upload particularly sensitive information (such as medical or legal information) — do so only if you are authorized and permitted to do so, and while taking into account the sensitivity of the material. It is recommended not to upload information whose exposure could cause serious harm, unless you are prepared for the risk involved.

5. Prohibited Content and Prohibited Use

It is prohibited to upload content that is unlawful, infringing, offensive, inciting, or defamatory, and to use the Service for any unlawful purpose, to harm others, to circumvent security or billing mechanisms, to reverse-engineer the Service, or to deliberately overload the system.

The Company may remove infringing content, suspend, or restrict access — after providing notice where circumstances permit, or immediately in the event of a serious violation, risk of harm, or a legal requirement.

Encountered infringing content on the Service? Report it to us at asr@tamleluya.com and we will act to review and remove it in accordance with the law.

6. Content Processing — Artificial Intelligence and Human Involvement

In order to generate the output, the content you upload is processed using transcription engines and external artificial intelligence providers, as detailed in the Privacy Policy. This processing is carried out solely for the purpose of providing the Service to you.

If you choose to share a file for human correction or proofreading (including a transcriber service), the party with whom you share it will gain access to the material in accordance with the scope of sharing you selected. Such sharing is done at your own initiative and is your responsibility.

7. Storage and Deletion of Files

Source files, transcripts, and outputs are stored on the Service for 30 days from the date of their creation, after which they are automatically deleted from storage. Operational records (such as billing details and activity history) are retained as required by law.

It is your responsibility to download and save a copy of any transcript or file that is important to you before the retention period ends. You may also proactively delete files at any time through your account.

It is recommended that you keep an independent backup. The Company does not serve as a backup or archiving service.

8. Content Sharing by You

The Service allows you to create sharing links and grant viewing, editing, or download permissions to others. You are solely responsible for selecting the parties with whom you share, the scope of the permissions granted, and the consequences of such sharing. You may revoke sharing at any time through your account.

9. Payments, Credits, and Cancellations

The Service is based on the purchase of credits or a subscription, with billing according to actual usage. Up-to-date pricing appears on the pricing page. Payment processing is handled by an external payment provider; payment method details are not stored by us.

Credit validity: credits included in a subscription are valid for three months from the date they are granted; credits purchased separately are valid for 12 months. Credits used for completed work are non-refundable; for work that failed due to a system fault, the credits reserved for it will be refunded.

Cancellation of a transaction: in accordance with the Consumer Protection Law, 5741-1981, a distance sale transaction may be cancelled within 14 days of its execution, with a refund for the unused portion, less a lawful cancellation fee. A recurring subscription may be cancelled at any time, and the cancellation will take effect at the end of the current billing period. For cancellations: asr@tamleluya.com or through your account.

Credits and benefits granted free of charge (such as a registration bonus or free quotas) are a benefit that may be changed or discontinued, subject to reasonable advance notice regarding benefits that were explicitly promised.

10. Intellectual Property

The content you upload and the transcripts produced from it belong to you. You grant the Company a limited, non-exclusive license, for the retention period only, to store, process, and transfer the content to subcontractors — solely to the extent required to operate, secure, and improve the Service, and in accordance with the Privacy Policy. We do not make any other commercial use of your content.

All intellectual property rights in the Service itself — including the software, technology, design, and interface — are reserved to the Company. You may not copy, reproduce, or create derivative works from the Service without express written permission.

11. Limitation of Liability

The Company takes reasonable measures to secure information and maintain the Service's proper functioning, but no online system is entirely immune to malfunctions, breaches, or data loss, and absolute security cannot be guaranteed. Please consider the sensitivity of your material before uploading it, and keep an independent backup.

Subject to the provisions of any law that cannot be waived: the Company shall not be liable for indirect, consequential, or special damages, or for loss of profit, goodwill, or data; and the Company's total liability, on any grounds whatsoever, shall be limited to the amounts you actually paid the Company in the 12 months preceding the event, or to NIS 100 — whichever is higher.

Nothing in these Terms derogates from rights granted to you under any law that cannot be waived, including the Consumer Protection Law and the Privacy Protection Law.

12. Indemnification

You undertake to indemnify the Company for any damage, reasonable expense, or third-party claim arising from your breach of your obligations under these Terms — including unlawfully uploading recorded or uploaded content, infringing third-party rights, or failing to obtain required consents. The Company will notify you of any such claim and allow you to defend against it.

13. Suspension and Termination

You may stop using the Service at any time and request deletion of your account by contacting us.

The Company may suspend or terminate an account in the event of a breach of these Terms or the law — following a warning, except in the case of a serious breach or a genuine risk of harm, in which case suspension may be immediate. Upon termination of an account not due to a breach, you retain the right to a proportional refund for any unused balance paid, in accordance with law.

Upon account deletion, files and outputs will be deleted; records required to be retained by law (such as billing documentation) will be kept as required.

14. Changes to the Terms and the Service

The Company may update these Terms from time to time. We will notify you in advance of any material change — via notice on the site or by email — and continued use will be conditioned on renewed acceptance of the updated Terms. The current version of the Terms and its update date appear at the top of this page.

The Company may change, improve, or discontinue features of the Service. A complete discontinuation of the Service will be accompanied by reasonable advance notice and the option to download your content and receive a proportional refund for any unused balance.

15. Governing Law, Jurisdiction, and Miscellaneous

These Terms shall be governed by the laws of the State of Israel. Exclusive jurisdiction is granted to the competent courts in Tel Aviv-Jaffa.

If any provision of these Terms is found to be void or unenforceable, the remaining provisions shall remain in effect, and the provision shall be replaced with a valid provision closest to its original intent.

Failure by the Company to enforce a right does not constitute a waiver thereof. These Terms constitute the entire agreement between the parties regarding the Service.
